Accepting these terms

These Terms of Use (“Terms”) are an agreement between you and Smart21Brain (“we”, “us”). By creating an account or using smart21brain.com and our related tools (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. If you are under 18, please read these Terms with a parent, guardian or teacher.

Who can use Smart21Brain

• The Service is for learners, parents, teachers, schools and institutions.
• Children under 13 (or the age of digital consent where they live) may use the Service only with the permission and supervision of a parent, guardian or teacher.
• You must give accurate information when you register and keep it up to date.
• If you create an account for a school, institution or business, you confirm you are authorised to do so.

Your account

• You are responsible for keeping your password confidential and for everything that happens under your account.
• Tell us immediately if you think someone else has used your account.
• One person should use one account. Do not share accounts or sell or transfer them.
• We may suspend or close accounts that break these Terms or put others at risk.

Acceptable use

You agree not to:

• break any law or the rights of others;
• upload, post or share content that is unlawful, abusive, harassing, hateful, sexually explicit, violent, or harmful to children;
• bully, threaten or impersonate other people, or collect their personal information;
• cheat in quizzes, games or exams, or misuse certificates;
• try to gain unauthorised access to the Service, other accounts or our systems, or interfere with or overload them;
• upload viruses or other malicious code, or use bots, scrapers or automated tools to copy the Service without our permission;
• copy, resell or republish our courses, videos, books or other content except as these Terms allow; or
• use the AI tools to produce harmful, deceptive or unlawful content.

Your content

You keep ownership of content you create or upload (“Your Content”). By posting it on the Service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, display and process it as needed to run and improve the Service, and to show it to the people you choose to share it with (for example your teacher or class). You promise that you own Your Content or have the right to use it, and that it does not break the law or anyone else’s rights. We may remove content that breaks these Terms.

Our content and intellectual property

Smart21Brain, its logo, courses, lessons, videos, books, games, quizzes, software and design are owned by us or our licensors and are protected by copyright, trademark and other laws. We give you a limited, personal, non-exclusive, non-transferable right to use them for your own learning or teaching. You may not copy, modify, distribute, sell or create derivative works from them without our written permission. Some materials are provided by third parties or teachers and remain subject to their own rights.

AI tools

The Service includes AI features such as the Study Buddy. AI replies are generated automatically and may be incomplete or wrong. They are for learning support only and are not professional, medical, legal or financial advice. Check important information with a teacher or another reliable source.

Schools and institutions

If a school or institution sets up a space on Smart21Brain, its administrators control that space and the information in it, and are responsible for using it lawfully and for having any permissions needed from learners and parents. Their use of your information is governed by their own policies as well as ours.

Paid features

Some features may be offered for a fee. Prices, billing details and any refund terms will be shown at the point of purchase and on our pricing page. Unless the law or the offer states otherwise, fees already paid are non-refundable. We may change prices for future purchases with reasonable notice.

Availability and changes

We work hard to keep the Service running, but we do not promise it will always be available, error-free or uninterrupted. We may add, change or remove features or content, or suspend the Service for maintenance, and we may update these Terms as described below.

Disclaimer

The Service and all content are provided “as is” and “as available”. To the fullest extent the law allows, we do not give any warranties, express or implied, including about accuracy, fitness for a particular purpose, or that learning outcomes or exam results will be achieved.

Limit of liability

To the fullest extent the law allows, Smart21Brain and its team will not be liable for indirect, incidental, special or consequential losses, or for loss of data, profits or opportunities, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim, or TZS 50,000 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law.

Ending your use

You can stop using the Service and ask us to delete your account at any time by emailing hello@smart21brain.com. We may suspend or end your access if you break these Terms or if we must do so by law. Sections that by their nature should continue (such as ownership, disclaimers and limits of liability) will continue after your account ends.

Governing law

These Terms are governed by the laws of the United Republic of Tanzania. Any dispute will be handled by the courts of Tanzania, unless the law of your country gives you the right to bring a claim elsewhere. We encourage you to contact us first so we can try to resolve any problem informally.

Changes to these Terms

We may update these Terms from time to time. When we make important changes we will update the effective date above and, where appropriate, notify you. If you keep using the Service after changes take effect, you accept the new Terms.
